Weekly Rest (Industry) Convention, 1921 (No. 14) - Haiti (Ratification: 1952)

The Committee notes the information supplied by the Government in its report on the inconsistency in the Labour Code, section 107 of which provides that a weekly paid rest shall be granted consisting of “at the most” (rather than “at least”) 24 consecutive hours. The Government indicates that this error will be corrected at the appropriate time, in order to bring Haitian legislation into conformity with the Convention. However, the Committee understands that it is a simple printing error, as indicated by the Government in a previous report. In the comments it made on this subject in 2002, the Haitian Trade Union Coordination (CSH) confirmed that in practice weekly rest of at least 24 hours is granted to workers. Should the Government confirm that the use of the term “at the most” and not “at least” was the result of a simple printing error, then it might be suggested that the most practical solution would be a correction in “Le Moniteur”, not requiring formal revision of the Labour Code. The Committee requests the Government to keep it informed of the measures that it takes on this issue.
