Indigenous and Tribal Peoples Convention, 1989 (No. 169) - Germany (Ratification: 2021)

The Committee takes note of the first report of the Government on the application of the Convention. It notes the Government’s indication that after extensive debate the Government was able to establish broad political consensus on the ratification of the Convention and that there are no population groups living within the jurisdiction of the Federal Republic of Germany within the meaning of Article 1(1)(a) (tribal peoples) or within the meaning of Article 1(1)(b) (indigenous peoples).
The Committee further notes that the Government stresses that by ratifying the Convention, Germany not only wants to strengthen the Convention internationally, but also to support Germany’s human rights, climate action, and development policy objectives. The Government adds that the protection of the rights of indigenous peoples is a high priority in the context of German development cooperation and that, in its development policies, it places great emphasis on taking into account indigenous peoples’ rights and carefully examines the effects of measures and projects on indigenous people and local communities, both before and during the implementation process.
The Committee welcomes this ratification which bears witness to the Government’s commitment to promote indigenous and tribal people’s rights. The Committee hopes that this could contribute positively towards the ratification of the Convention by other countries and to reinforce the impact and relevance of the Convention.
