Employment Service Convention, 1948 (No. 88) - Tunisia (Ratification: 1968)

Direct Request (CEACR) - adopted 2023, published 112nd ILC session (2024)

Article 1 of the Convention. Contribution of the employment service to employment promotion. The Government indicates that the National Employment and Self-employment Agency (ANETI) works to meet the labour needs of enterprises by placing jobseekers and by organizing employment promotion programmes and additional training sessions. The Government adds that the ANETI strives to integrate jobseekers by offering them job-related training and retraining and personalized support in developing and implementing their career plans. Regarding the number of existing public employment offices, the Government indicates that the ANETI now has a network of 111 employment and self-employment offices (BETI), compared with 83 offices in 2015. In 2021, 108,135 persons were registered as active jobseekers with BETI, including 62,301 women. The same year, the ANETI received 25,475 vacancies and made a total of 36,365 placements, including 29,366 placements following an internship. The Committee refers to its comments on the Employment Policy Convention, 1964 (No. 122), and requests the Government to continue to provide updated information on the manner in which the public employment service contributes to the best possible organization of the employment market, to full employment and to the use of productive resources. The Committee also requests the Government to continue to provide information on the number of public employment offices, applications for employment received, vacancies notified and placements made by the public employment service.
Articles 4 and 5. Participation of the social partners. The Government indicates that the National Social Dialogue Council established by Act No. 2017-54 of 24 July 2017 is the institutional framework for tripartite dialogue on social and economic matters of common interest, including employment, vocational training and social protection matters. In this respect, the Government indicates that the national employment strategy is based on a participatory tripartite approach involving all the stakeholders at all stages: design, implementation, monitoring and evaluation. The Government adds that the representative organizations of employers and workers are now members of the ANETI councils. In addition, since the adoption of Government Decree No. 2019-802 of 15 August 2019, every vocational training establishment includes a tripartite partnership council, responsible for determining appropriate training methods and any necessary updates to the programme content, in line with the needs of the labour market. The Committee requests the Government to continue to provide updated and detailed information on the manner in which employers’ and workers’ organizations are consulted on the organization and operation of the employment service and in the development of employment service policy.

Article 1 of the Convention. Contribution of the employment service to employment promotion. In its report, the Government indicates that the Tunisian Employment and Self-employment Agency (ANETI) has a network consisting of 83 multiservice offices, ten offices for the employment of managerial staff and 16 “enterprise” centres. During 2014, ANETI received 691,969 applications for employment (including 555,354 re-registrations), 100,486 vacancies were notified and 71,096 training courses were offered, with 61,484 placements being made. In this regard, the Committee refers to its comments on the Employment Policy Convention, 1964 (No. 122). The Committee requests the Government to provide updated information on the manner in which the public employment service contributes to the best possible organization of the employment market as an integral part of the national programme for the achievement and maintenance of full employment and the development and use of productive resources. It also requests the Government to continue providing information on the number of public employment offices established, applications for employment received, vacancies notified and the number of persons placed in employment by ANETI.
Articles 4 and 5. Participation of the social partners. The Government indicates that the Ministry of Vocational Training and Employment works in consultation and collaboration with the social partners for the design and implementation of employment and vocational training policies. The Committee requests the Government to continue providing detailed information on the manner in which employers’ and workers’ organizations are consulted on the organization and operation of the employment service and the development of employment service policy.

The Committee notes that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its previous comments.

The Government indicates that there are 100 offices dealing with employment and self-employment, comprising ten offices for managerial posts, 79 offices providing multiple services and 11 “enterprising” centres. The trends in job vacancies, applications and placements via the Tunisian Employment Agency (ANETI) appear to give cause for concern: in 2011, some 140,000 job vacancies were notified, 280,000 applications were received but only 46,471 placements were carried out. In view of the worrying situation of the employment market, which is also referred to in its comments on the application of the Employment Policy Convention, 1964 (No. 122), the Committee invites the Government to arrange for the cooperation of the social partners in the organization and operation of the employment service (Articles 4 and 5 of Convention No. 88). The Committee would also welcome receiving up to-date information on the manner in which the public employment service contributes to the best possible organization of the employment market as an integral part of the national programme for the achievement and maintenance of full employment and the development and use of productive resources (Article 1(2) of the Convention). The Government is also requested to include statistical information in its next report on the number of public employment offices established, the number of applications for employment received, the number of vacancies notified and the number of persons placed in employment by ANETI. The Committee hopes that this information will make it possible to assess the effectiveness of ANETI (Part IV of the report form).

The Government indicates that there are 100 offices dealing with employment and self-employment, comprising ten offices for managerial posts, 79 offices providing multiple services and 11 “enterprising” centres. The Committee notes with regret that the Government’s report has not been received. It noted the brief indications provided by the Government in a report received in September 2009 concerning the legislative texts governing the Tunisian Employment Agency. It requests the Government to provide, as it has in the past, statistical data on the number of public employment offices established, the number of applications for employment received, the number of vacancies notified, and the number of persons placed in employment by these offices (Part IV of the report form).

The Committee notes the brief indications provided by the Government in a report received in September 2009 concerning the legislative texts governing the Tunisian Employment Agency. It requests the Government to provide, as it has in the past, statistical data on the number of public employment offices established, the number of applications for employment received, the number of vacancies notified, and the number of persons placed in employment by these offices (Part IV of the report form).

The Committee notes the reports sent by the Government in September 1998 and April 1999. It notes that Decree No. 97-1930 of 29 September 1997 establishes new powers and functions for employment offices coming under the Tunisian Employment Agency. It hopes that the Government will continue to provide available statistical information on the number of public employment offices established, the number of applications for employment received, the number of vacancies notified, and the number of persons placed in employment by such offices, in accordance with Part IV of the report form. Please also give a general appreciation, in the light of the implementation of Decree No. 97-1930, on the manner in which the Convention is applied, together with information on any practical difficulties encountered in applying it (Part VI of the report form).

The Committee notes that the Government has still not forwarded to the ILO the information it referred to in its report on the application of the Convention for the period ending 30 June 1993. It hopes that this information will be provided as soon as possible so that the Committee may examine it. Please supply, in particular, all available statistical information on the number of public employment offices established, the number of applications for employment received, the number of vacancies notified and the number of persons placed in employment by such offices, in accordance with Part IV of the report form. Please also give a general appreciation of the manner in which the Convention is applied and information on any practical difficulties in the application of the Convention (Part VI of the report form).
