Case No 3138 (Republic of Korea) - Complaint date: 18-JUN-15International Trade Union Confederation (ITUC), Korean Confederation of Trade Unions (KCTU) and Federation of Korean Trade Unions (FKTU) The complainant organization alleges that an official plan launched in April 2015 by the Ministry of Labour promotes the revision of collective agreements in force containing clauses deemed illegal or unreasonable by the Government, as follows: (i) Government survey of some 3000 collective agreements concluded in enterprises with 100 or more full-time workers; (ii) in case of identified illegal clauses (e.g. preferential or special recruitment of family members), recommendation of revision and, where necessary, issuance of correction orders, and bringing of charges if need be; (iii) in case of identified “unreasonable” clauses (e.g. consultation of trade unions on personnel issues such as layoffs and reshuffling), recommendation of voluntary revision (e.g. via incentives); and (iv) strengthening of field guidance on collective bargaining so that future collective agreements will not include such clauses.

Case No 2620 (Republic of Korea) - Complaint date: 18-DEC-07Korean Confederation of Trade Unions (KCTU) and International Trade Union Confederation (ITUC) The complainants allege that the Government refused to register the Migrants’ Trade Union (MTU) and carried out a targeted crackdown on this union by successively arresting its Presidents Anwar Hossain, Kajiman Khapung, and Toran Limbu, VicePresidents Raj Kumar Gurung (Raju) and Abdus Sabur and General Secretary Abul Basher Moniruzzaman (Masum), and subsequently deporting many of them. The complainants add that this has taken place against a background of generalized discrimination against migrant workers geared to create a low-wage labour force that is easy to exploit.

Case No 2602 (Republic of Korea) - Complaint date: 10-OCT-07Korean Metalworkers’ Federation (KMWF), Korean Confederation of Trade Unions (KCTU) and International Metalworkers’ Federation (IMF) The complainants allege that “illegal dispatch” workers, i.e. precarious workers in disguised employment relationships, in Hyundai Motors’ Corporation (HMC) Ulsan, Asan and Jeonju plants, Hynix/Magnachip, Kiryung Electronics and KM&I, are effectively denied legal protection under the Trade Union and Labour Relations Adjustment Act (TULRAA) and are left unprotected vis-à-vis: (1) recurring acts of anti-union discrimination, notably dismissals, aimed at thwarting their efforts to establish a union; (2) the consistent refusal of the employer to bargain as a result of which none of the unions representing those workers have succeeded in negotiating a collective bargaining agreement; (3) dismissals, imprisonment and compensation suits claiming exorbitant sums, for “obstruction of business” in case of industrial action; (4) physical assaults, court injunctions and imprisonment for “obstruction of business” aimed at preventing dismissed trade union leaders from re-entering the premises of the company to stage rallies or exercise representation functions
