The case was last examined by the Committee at its March 2010 meeting [see 356th Report, paras 43–45] and concerns a number of provisions of the Labour Code that have been contested by the complainant organization (the Cape Verde Confederation of Free Trade Unions (CCSL)). In its previous examination of the case, the Committee had taken note of the measures adopted to give effect to its recommendations, in particular by the Council for Social Consultation regarding proposed amendments or modifications to sections 15, 70, 110 and 353 of the Labour Code in order to bring them into conformity with the Committee’s recommendations.

In a communication dated 13 September 2010, the CCSL expresses its satisfaction at the fact that, with the adoption of a Legislative Decree on 16 June 2010 and its publication on the same day in Official Journal, Series I, No. 22, the provisions of Legislative Decree No. 5/2007 of 16 October 2007 concerning sections 15, 70, 110 and 353 of the Labour Code have been amended. The complainant organization considers that the amendments in question meet the concerns which prompted it to present a complaint to the Committee.
- 32. The Committee takes due note of this information, and expresses its satisfaction, not only with the legislative amendments that have been made in line with its previous recommendations but also with the tripartite consultation that has been a feature of this process.
