Article 3 of the Convention. Worst forms of child labour. Clause (b). Use, procuring or offering of a child for prostitution, pornography or pornographic performances. Prostitution.  The Committee previously noted the Government’s information that the Penal Code, as amended in 2012, under section 377D criminalizes the offences related to obtaining the sexual services of a person under the age of 18 years while sections 377E and F provide for penalties to any citizen of Brunei Darussalam who commits an offence under section 377D outside the country.  The Committee requested the Government to provide a copy of the Penal Code as amended.
The Committee notes that a copy of the Penal Code, Revised Edition 2016 which contains the abovementioned provisions has been supplied by the Government along with its report.
Clause (d) and Article 4(1). Hazardous work and determination of hazardous work.  The Committee previously noted the Government’s statement that the Department of Labour was undergoing preliminary discussions with a view to formulating a list of types of hazardous work prohibited to young persons under the age of 18 years. 
The Committee notes the Government’s information that the Department of Labour and the Attorney General’s Chambers have undertaken consultations to formulate a list of types of hazardous work prohibited to young persons under the age of 18 years. It is anticipated that the list will comprise and state occupations that may jeopardize the health, safety and morals of children and young persons as occupations which no child or young person may be employed in. The list of hazardous work is intended for finalization in 2020 after consultations with the relevant stakeholders, including the regulatory and law enforcement agencies of the Government of Brunei Darussalam. The Committee expresses the firm hope that the list of types of hazardous work prohibited to young persons under the age of 18 years will be finalized and adopted in the near future, after consultation with the organizations of employers and workers concerned. It requests the Government to provide information on any progress made in this regard.
