Comments and Observations: | Govt. of Liberia (19 January 2023) Please be informed that the Manager has confirmed that the vessel is under arrest, the owner has abandoned the vessel, and the MLC Financial Security has been activated. The Crew are waiting to be paid their outstanding wages and repatriated. The P and I Club (The Swedish Club) has confirmed that they have managed to know how much due to the crew from the master. According to the Club, an Australia lawyer is now clearing his conflict and they will properly advise us this week on their plan of action to execute their obligations.
We expect to receive their plan of actions before the end of this week and we will keep you updated.
Govt. of Liberia (27 January 2023) The crew has not received part of their wages for October and November. December wages have been paid. The vessel is alongside and under arrest by the Admiralty Marshal.
On January 3, 2023, The Liberian Administration requested both the Shipowner and P&I club for their action to resolve the abandonment case.
On January 4, 2022, The Shipowner informed the Administration that the vessel is under arrest in Australia due to commercial disputes. The vessel is in the care of the Admiralty Marshal, who is responsible for maintaining the crew and vessel. The shipowner paid the crew wages for August, September, and October without reimbursement from her principal. she terminated Shipman on November 8, 2022, to limit her liabilities.
On January 20 and 25, 2023, The P&I Club informed the Administration that the ship was in the process of judicial sale. The tender bids for the purchase of the vessel are to close on February 10, 2023, with the vessel's sale to be completed before February 20, 2023. The Marshal has paid the crew December wages and repatriated 19 crew members to Manila. The Marshal will maintain the vessel and the remaining crew while the vessel remains under arrest and in her custody.
The Club is trying to plan for payment of the crew's outstanding wages and entitlements prior to December 2022 and for the repatriation of the remaining crew members as required. The Club is also investigating the final destination of the 19 crewmembers to ensure they are duly repatriated.
Govt. of Liberia (5 June 2023) On April 20, 2023: The manning agency confirmed that the crew have been repatriated and paid their outstanding wages except severance pay, November wages and a portion of their shipboard pay. On May 30, 2023, the manning agency confirmed that the crew have been have received all their outstanding wages including severance pay, November wages and all their shipboard pay.
Please be informed that the case has been resolved. All the seafarers have been paid and fully repatriated.
